1. GENERAL

1.1 Growmatcher AB, reg. no 559266-7876, (”Growmatcher”) provides a service that helps the Customer find suitable candidates for vacancies they have. These matches are made at www.Growmatcher.com (the “Service”). An integrated part of the agreement regarding the Service are Growmatcher’s terms and conditions (the ”Terms”).

1.2 Growmatcher takes your privacy seriously. Growmatcher may receive and process sensitive information such as personal data (”Personal Data”). This privacy policy (the “Privacy policy") explains and regulates Growmatcher’s handling of such sensitive information. This Privacy Policy is established in accordance with The General Data Protection Regulation (EU) 2016/679 (”GDPR)” and the current Swedish national laws and regulations.

1.3 Words with initial capital letter in this Privacy policy shall have the same meaning as in the Terms.

2. COLLECTION AND PROCESSING OF PERSONAL DATA

2.1 When using the Service the Customer might transfer Personal Data to Growmatcher. The Customer is the data controller and Growmatcher the personal data processor in relation to the Customer and the Personal Data that Growmatcher receives from the Customer. The Customer is responsible and guarantees that the Personal Data submitted to Growmatcher have been obtained with the individual's consent or on other legal basis, and that the Personal Data can be used by Growmatcher and otherwise meet the requirements of the law in order to protect the individual's right to privacy.

2.2 Growmatcher can occasionally collect and process Personal data, both to perform and provide the Service and to communicate with users of the Service. Growmatcher is the data controller for such tasks.

2.3 Personal Data that Growmatcher collects may be Personal Information and contact information such as name, username, billing and shipping address, email address, mobile phone number etc.

2.4 Growmatcher may also collect geographical information, device information-such as. IP address, language settings, browser settings, time zone, operating system, platform and screen resolution.

2.5 Growmatcher continually strive to develop its processes and systems in order to secure that both the collection and processing of Personal Data as well as the systems and procedures used for these purposes will have a built-in data protection (privacy by design). Growmatcher also strives to minimize the processing of Personal Data and do not process such information if not necessary (privacy by default)

3. THE PURPOSE OF PROCESSING OF THE PERSONAL DATA

3.1 Growmatcher collects and processes Personal Data for the following purposes:

(a) to provide and perform the Service, including to communicate and convey information to the Customer and the users of the Service.

(b) to be able to send messages (mainly via email) to the users of the Service,

(c) for general business development, such as the development of new services and features,

(d) to develop and improve the Service and its content as well as for accounting purposes, maintenance of customer relations, marketing and communications to the Customer,

(e) to ensure that the Service functions properly and effectively,

(f) to otherwise carry out its commitments to the Customers,

(g) to obtain information in order to improve IT-systems and develop better IT security for Growmatcher and its users. Protect Growmatcher’s IT environment against attacks and intrusion.

(h) to be able to provide information to authorities under law and binding regulations and decisions of the authorities,

3.2 The information provided to Growmatcher, as well as information about the Service and financial information, is generally necessary in order to establish a contractual agreement with Growmatcher, while the rest of the information Growmatcher collects is generally required for other purposes, as described above.

3.3 Growmatcher’s legal basis for the processing of Personal Data relating to paragraph 3.1 (a)–(g) is to fulfil its contractual obligations; vis-à-vis the Customer, i.e. Growmatcher’s agreements directly with the individual or indirectly through the Customer. The legal basis is also Growmatcher’s the legitimate interests of developing and improving the Service and the business. The legal basis for the purposes specified in paragraph 3.1 (h) is Growmatcher’s obligation to comply with applicable law.

3.4 The information and Personal Data which Growmatcher processes are protected against unauthorized access and disclosure through encryption and other technical measures.

4. TRANSFERING OF PERSONAL DATA TO A THIRD PARTY AND PUBLICATION OF INFORMATION

4.1 Growmatcher will only transfer Personal Data if it is necessary to fulfil its contractual obligations. In such cases Growmatcher is responsible for that the recipient will not use personal information for purposes that are incompatible with the purposes for which they are initially collected and set out in this privacy policy.

4.2 If all or part of Growmatcher’s business is transferred or integrated with another company, Personal Data may be disclosed to a potential buyer and its advisors. The new owners will continue to observe the commitments Growmatcher leaves in this Privacy policy.

6.4 Growmatcher may refuse the individual access to its Personal Data or refuse to update, correct or delete them, if Growmatcher considers the request to be unserious, the requests to be unreasonably repetitive, requires disproportionate technical effort (for example the development of a new system or significant changes to existing practice), risks the privacy of others or would be extremely impractical, for example, a request for information from Growmatcher’s system for backups). In addition, the update, rectification or deletion will be denied in cases where Growmatcher is obliged by law to store Personal Data. In these situations, the Personal Data may instead be blocked.

6.5 The individual may request and has the right to demand that the Personal Data is transferred to another data controller.

6.7 Growmatcher cannot however guarantee that the Service function as intended if information such as Personal Data is changed or deleted.

7. COMPLIANCE AND COOPERATION WITH REGULATORY AUTHORITIES

7.1 Growmatcher regularly evaluates and documents the data protection process, including compliance with this Privacy policy.

7.2 When Growmatcher receives formal written complaints the current individual will, if Growmatcher considers it necessary, be contacted and the case will be followed up. Growmatcher is cooperating with authorities, including local data protection authorities, to resolve any complaints regarding the Personal Data if the matter cannot be resolved directly with the individual concerned.

7.3 Growmatcher reports all incidents of accidental or unlawful destruction, loss or alteration of the Personal Data processed by Growmatcher or incidents that result in unauthorized disclosure of, or access to Personal Data to the Swedish Data Protection Authority. Such notification will be made as soon as possible and no later than 72 hours after Growmatcher has become aware of the incident. However, if there is no risk of violation of the rights of an individual Growmatcher may refrain from reporting the incident.

8. COOKIES AND OTHER TECHNICAL MEASURES

8.1 The website, www.Growmatcher.se, and the Service in general may use "cookies" and other technologies, e.g. pixel tags and web beacons. The Customer or visitor may at any time choose to remove such cookie files placed on a visitor's or the Customer's device. If the visitor or the Customer choose not to accept cookies and other technologies, Growmatcher cannot guarantee that the website or the Service will function as intended.

8.2 Growmatcher collects some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, clickstream data, (date- and timestamp)., The information is used in order to understand and analyze trends and users' behavior, administer the website, improve the service and content, and to collect information about users in aggregated level. Growmatcher may also use the information for marketing and advertising the Service.

9. UPDATES AND INFORMATION
